1. These Terms and Conditions

PlanMyEvent ("we", "us", "our") operates the website located at planmyevent.com.au including all subdomains, mobile sites, and applications (collectively, the "Website").

By using the Website, creating an account, or subscribing to our services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Website.

These Terms and Conditions may change at any time. We will make every effort to inform you when these Terms and Conditions are updated. Please read these Terms and Conditions regularly.

2. About the Platform

PlanMyEvent is an online directory that connects event planners ("Customers") with event service providers ("Vendors"). We do not provide event services directly and are not a party to any agreement between Customers and Vendors.

We provide visibility and planning tools only. All transactions, bookings, and service delivery occur directly between Customers and Vendors.

3. User Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to create an account.

You must not create multiple accounts, impersonate another person, or use another person's account without permission.

We reserve the right to suspend or terminate accounts that violate these terms or that we reasonably believe are being used fraudulently.

4. Customer Terms

Customers may browse vendors, send enquiries, leave reviews, and use planning tools. Customers are responsible for their own interactions with Vendors.

PlanMyEvent does not guarantee the quality, safety, legality, or availability of any vendor's services. We recommend that Customers conduct their own due diligence before engaging any Vendor.

Reviews must be honest, based on genuine experiences, and not contain offensive, defamatory, or misleading content. We reserve the right to remove reviews that violate these terms.

5. Vendor Advertising Terms

Vendors may list their business on the Platform subject to subscription plans (Free, Standard, or Premium). By creating a listing, you agree to the following:

  • All information in your listing must be accurate, current, and not misleading
  • You must have the right to use all images, text, and content in your listing
  • Your listing must comply with all applicable Australian laws and regulations
  • You must not post content that is obscene, offensive, defamatory, or unsuitable
  • You must respond to customer enquiries in a timely and professional manner

PlanMyEvent reserves the right to reject, remove, or modify any listing at any time and for any reason, without obligation to provide reasons.

6. Subscriptions & Payments

Billing: All subscriptions (Vendor and Customer Premium) are billed quarterly (every 3 months) via Stripe. Subscriptions auto-renew unless cancelled. All prices are in Australian Dollars (AUD) and include GST.

Vendor Plans: Free ($0), Standard ($29/quarter), and Premium ($59/quarter). Features and limits for each plan are described on our Pricing page.

Customer Premium: $9.99/quarter. Unlocks unlimited event pages, guest list with RSVP tracking, unlimited folders, notes, and favourites. Vendors on Standard or Premium plans automatically receive all Customer Premium features at no additional cost.

Cancellation: You may cancel your subscription at any time from your Dashboard or the Pricing page. Cancellations take effect at the end of the current billing period. You retain access to paid features until the period ends. Vendor listings revert to the Free plan after cancellation.

Reactivation: If you cancel and change your mind before the billing period ends, you may reactivate your subscription from the Pricing page or Dashboard.

Upgrades: When upgrading from Standard to Premium, your existing subscription is cancelled and a new subscription is created at the higher rate.

Deletion: If you delete your vendor profile, all active subscriptions will be cancelled immediately.

Fee changes: We reserve the right to change subscription fees with 30 days written notice. Fee changes will apply from your next billing period.

Payment security: All payments are processed securely by Stripe. We do not store your credit card details on our servers. Stripe is PCI-DSS Level 1 certified.

7. Refund Policy

No partial refunds: Refunds are not provided for partial billing periods. If you cancel mid-quarter, your paid features remain active until the end of that quarter.

Exceptions: Refunds may be considered at our discretion in the following circumstances:

  • You were charged in error (e.g., duplicate payment)
  • The Platform experienced extended downtime preventing access to paid features
  • You were charged after cancelling due to a technical error

How to request a refund: Contact us at support@planmyevent.com.au within 14 days of the charge. Include your account email and the reason for your request. We aim to respond within 5 business days.

Australian Consumer Law: Nothing in this policy limits your rights under the Australian Consumer Law. If our services have a major failure, you are entitled to a refund.

8. Plan Features & Limits

Each subscription plan has specific features and limits as described on our Pricing page. These include limits on photos, enquiries, and available features. We reserve the right to modify plan features with reasonable notice.

Free plan vendors receive limited visibility and features. Upgrading unlocks additional features as described on the Pricing page.

9. Reviews & Ratings

Reviews must be honest and based on genuine experiences with the Vendor. Users must be signed in to leave a review. Each user may only leave one review per Vendor.

Vendors must not:

  • Post their own reviews or incentivise fake reviews
  • Direct PlanMyEvent to delete or amend legitimate reviews
  • Harass or intimidate customers who leave reviews

We reserve the right to remove reviews that are fraudulent, abusive, contain personal attacks, or violate these terms. Reviews are displayed only for Standard and Premium vendors.

10. Intellectual Property

PlanMyEvent owns all intellectual property rights in the Website, including design, software, and content, except where users have provided their own content.

By submitting content (including photos, text, and descriptions) to PlanMyEvent, you grant us a worldwide, royalty-free license to publish and display that content on the Website for the purpose of operating the Platform.

You warrant that you own or have permission to use all content you submit and that it does not infringe any third party's intellectual property rights.

11. Enquiries & Communications

Customer enquiry details (name, email, phone, event details) are shared with Vendors according to their subscription plan. Vendors must keep customer information confidential and use it only for the purpose of responding to the enquiry.

Vendors must not share, sell, or distribute customer contact information to third parties.

Marketing Communications: By creating an account, you consent to receive occasional emails from PlanMyEvent about service updates, new features, tips, and promotional offers. You may unsubscribe from marketing emails at any time by clicking the "unsubscribe" link in any email or by contacting us at support@planmyevent.com.au. We will never share your email with third parties for marketing purposes.

12. Prohibited Conduct

Users must not:

  • Post false, misleading, or deceptive information
  • Harass, threaten, or abuse other users
  • Use the Platform for illegal purposes
  • Attempt to circumvent security measures or subscription limits
  • Scrape, copy, or reproduce content from the Platform
  • Interfere with the operation of the Website
  • Create multiple accounts to circumvent restrictions
  • Use automated tools to access the Platform without permission

13. Limitation of Liability

PlanMyEvent is provided "as is" without warranties of any kind. We are not liable for:

  • Any disputes between Customers and Vendors
  • The quality, safety, or legality of any vendor's services
  • Loss of data or service interruptions
  • Any indirect, special, or consequential loss or damage
  • Loss of profits, revenue, business opportunity, or anticipated savings

Our total liability is limited to the amount paid by you to PlanMyEvent in the preceding 12 months.

PlanMyEvent makes no representation or warranty in relation to the number of visitors to the Website or the number of enquiries a Vendor will receive.

14. Indemnity

You agree to indemnify and hold harmless PlanMyEvent, its employees, and agents against all claims, actions, and demands arising from your breach of these Terms, your use of the Platform, or any content you submit.

15. Termination

We may suspend or terminate accounts that violate these terms at any time without notice. You may delete your account at any time from your Dashboard.

Upon termination, your listing will be removed from the Website and any active subscriptions will be cancelled.

16. Governing Law

These terms are governed by the laws of Victoria, Australia. Any disputes will be resolved in the courts of Victoria, and you irrevocably submit to the jurisdiction of those courts.
